Terms of Service

1. Introduction

Welcome to Tenisime – a social tennis and padel platform available at tenisime.com. Tenisime enables players to find playing partners, organize matches, track scores and statistics, participate in tournaments and leagues, and communicate with other players.

These Terms of Service ("Terms") govern your use of the Tenisime mobile application and related services. Please read these Terms carefully before using the app.

2. Acceptance of Terms

By creating an account or using the Tenisime app, you confirm that:

• You have read and accept these Terms
• You have read the Tenisime Privacy Policy
• You meet the minimum age requirement
• You have the legal capacity to enter into a binding agreement

If you do not accept these Terms, you may not use the Tenisime app.

3. Eligibility

To use Tenisime, you must:

• Be at least 16 years of age (as required by GDPR for Polish users)
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using our services under applicable law
• Provide accurate, current, and complete information during registration

By registering, you confirm that you meet these requirements. We reserve the right to verify this information and remove accounts that do not meet the criteria.

4. Account Responsibilities

As a Tenisime user, you are responsible for:

• Keeping your login credentials (password, authentication tokens) confidential
• All activities that occur under your account
• Notifying us immediately of any unauthorized account use at contact@tenisime.com
• Keeping your profile information accurate and up to date
• Accurately and honestly reporting match results – you are responsible for the correctness of any results you submit

We are not responsible for losses resulting from unauthorized access caused by your failure to maintain security.

5. Acceptable Use

When using Tenisime, you agree not to:

• Use the app for any purpose unlawful under Polish or European law
• Harass, abuse, threaten, or otherwise harm other users
• Impersonate any person, player, or entity
• Post false, misleading, or offensive content
• Submit false match results or manipulate rankings
• Attempt to gain unauthorized access to Tenisime systems
• Disrupt the functioning of the app or infrastructure
• Use bots, scripts, or automated means without our permission
• Violate the privacy of other users or collect their data without consent
• Send unsolicited messages (spam) to other users

Violation of these rules may result in immediate suspension or deletion of your account.

6. User Content

You retain ownership of content you create and publish in the app. By posting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content solely to the extent necessary to provide the app's services.

You are solely responsible for:

• The accuracy and truthfulness of information you post, including match results
• Ensuring your content does not infringe any third-party rights or applicable laws
• Obtaining any necessary consents when posting content that includes other people's data

We reserve the right to remove content that violates these Terms or applicable law.

7. Push Notifications

Tenisime sends push notifications in the following categories:

• Messages – new messages from other users
• Match Invitations – invitations to games
• Friend Requests – new connection requests
• Nearby Games – match listings within your location radius
• Tournaments – tournament notifications
• Leagues – league updates
• Trainings – training session notifications
• Activity Reminders – reminders about scheduled matches

You can manage notifications in the app settings:

• Each notification category can be toggled on or off independently
• For the "Nearby Games" category, you can set a notification radius from 5 to 100 km
• You can disable all notifications via your device operating system settings

Disabling notifications does not affect your ability to use other app features.

8. Premium Subscription and Payments

Tenisime is free to use at its core. Certain features — in particular the AI Coach (unlimited AI coach chat and an adaptive weekly training plan) — are available through a paid Premium subscription.

Plans and pricing. Premium is offered on a monthly and an annual basis. Current prices are shown in the app before purchase. A free trial period (e.g. 7 days) may be available; its terms are stated in the app.

Payment processing. Purchases and billing are handled through your App Store (Apple) or Google Play (Google) account, subject to those platforms' terms. We do not store or process your payment card details.

Managing and cancelling. You manage and cancel your subscription in your App Store or Google Play account settings. Cancelling stops future renewals; Premium access remains active until the end of the paid period.

Right of withdrawal. If you are a consumer, you have a 14-day right to withdraw from the contract. By starting to use the digital content or services (including a trial or Premium features) before that period ends, you expressly request that performance begin and acknowledge that you lose the right of withdrawal once the service has been fully performed.

Refunds. Refunds are handled under App Store and Google Play policies, as those platforms process payments. Contact the relevant store for refunds; in justified cases we will help at contact@tenisime.com.

Price changes. We will notify you in advance of any changes to pricing or Premium scope. Changes do not affect an already-paid period.

9. Intellectual Property

The Tenisime app, its logo, graphic design, source code, and all original features are owned by the Tenisime operator and are protected by copyright, trademark, and other intellectual property laws.

Without our prior written consent, you may not:

• Copy, reproduce, or distribute the app or its elements
• Modify, decompile, or create derivative works based on the app
• Use the Tenisime logo, name, or trademarks for commercial purposes

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

Tenisime is a social platform acting as an intermediary enabling players to connect and organize meetings. We are not responsible for:

• Actual in-person meetings or physical events organized via the app
• User behavior during off-app meetings
• The accuracy of user-provided information, including match results
• The availability of courts shown on the map
• Service interruptions caused by external factors

You use the app and organize meetings at your own risk.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY POLISH AND EUROPEAN LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP.

Our total liability to you, regardless of the legal basis of the claim, shall not exceed USD 25 or the amount you paid us in the past 12 months, whichever is greater.

These limitations do not apply to the extent that mandatory law provides for liability for intentional misconduct or gross negligence.

12. Termination

You may delete your account at any time from the app settings or by contacting us at contact@tenisime.com.

We may suspend or delete your account without prior notice in the event of:

• Breach of these Terms
• Suspected unlawful activity
• Prolonged account inactivity

Upon account deletion, your data will be removed in accordance with our Privacy Policy. Provisions that by their nature should survive termination will remain in effect.

13. Governing Law

These Terms are governed by Polish law, in particular the Civil Code, the Act on Provision of Electronic Services, and the GDPR.

Any disputes arising from these Terms or the use of Tenisime shall be resolved by the courts having jurisdiction over the operator's place of residence in Poland.

If you are a consumer under Polish law, you benefit from additional consumer protection rights that are not limited by these Terms.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes at least 14 days in advance by:

• Displaying a notification in the app
• Sending an email to the address on file
• Updating the "Last updated" date at the top of this document

Your continued use of the app after changes take effect constitutes acceptance of the new Terms. If you do not accept the changes, you should stop using the app and delete your account.

15. Clubs and the Organizer plan

A club submitted in the app and approved by Tenisime uses the app free of charge, with every feature, as long as the number of the club's active players does not exceed 50. Active players are accounts taking part in the club's running competitions and club members active in the app in the last 30 days; players added by an organizer without an app account are not counted.

The Organizer plan is intended for clubs and organizers above this threshold. The planned price is USD 25 per month.

Once charging starts, a club that exceeds the threshold without a plan will not be able to create new competitions or new cycles; competitions already started and the current cycles can be finished. Tenisime never blocks players because a club has no plan.

Tenisime may grant selected clubs (at most 10) the status of a partner club: no limit on active players for 12 months from the club's first approval, under the partner programme (including monthly feedback and consent to name the club as a partner).

The club plan is paid by the club's owner.
